Welcome to Fijara ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, platform, applications, and services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
These Terms constitute a legally binding agreement between you and Fijara. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.
To use our Services, you must meet the following requirements:
- Be at least 18 years of age or the age of majority in your jurisdiction
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using our Services under applicable law
- Provide accurate and complete registration information
By using our Services, you represent and warrant that you meet all eligibility requirements. We may refuse service, terminate accounts, or cancel orders at our discretion.
Fijara provides a modern platform for web and mobile development services, including:
- Project discovery and scoping with AI assistance
- Custom web and mobile application development
- Project management and tracking tools
- Communication and collaboration features
- Payment processing and invoicing
Service availability may vary by region. We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.
Account Creation
To access certain features, you must create an account. You agree to provide accurate, current, and complete information, maintain and update your information, keep your password secure and confidential, and accept responsibility for all activities under your account.
Account Types
- Client Accounts: For individuals or businesses seeking development services
- Affiliate Accounts: For partners referring clients to our platform
- Employee Accounts: For freelancers and developers working on projects
You must notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized account access.
Project Initiation
- Submit a project draft describing your requirements
- Receive AI-assisted clarification and feature suggestions
- Review and approve the project scope and pricing
- Make the initial payment to begin development
Development & Completion
During development, you will have access to real-time progress updates and communication through our messaging system. Upon completion, you receive a 7-day review period to verify deliverables. Revision requests must be submitted within this period.
Project timelines are estimates and may vary based on complexity and client responsiveness. Final payment is due upon project acceptance.
Pricing & Methods
Project pricing is determined based on type, complexity, features, design requirements, and timeline. All prices are displayed in USD unless otherwise specified. We accept Credit/Debit Cards (via Stripe), Paystack (for supported regions), and bank transfers for certain project values.
Refunds
Full refunds may be available before project work begins. Partial refunds may be considered based on work completed. No refunds for completed and accepted projects. Refund requests must be submitted in writing.
Client Ownership
Upon full payment, clients receive ownership of custom code developed specifically for the project, rights to use all deliverables for their intended purpose, and source code and documentation as specified in the agreement.
Fijara Ownership
We retain ownership of our platform, tools, and proprietary systems; pre-existing code, libraries, and frameworks; general knowledge and techniques developed during projects; and anonymized data for platform improvement.
Projects may include third-party components subject to their respective licenses. We will inform clients of any significant third-party dependencies.
When using our Services, you agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Submit fraudulent or misleading information
- Interfere with the operation of our Services
- Attempt to gain unauthorized access to our systems
- Use the Services for illegal or harmful purposes
- Harass, abuse, or harm other users or our staff

Service Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIJARA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, USE, OR GOODWILL; SERVICE INTERRUPTIONS OR DATA LOSS.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify and hold harmless Fijara from any claims, damages, losses, and expenses arising from your use of the Services, violation of these Terms, or violation of any third-party rights.
Termination
You may terminate your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms, we are required by law, or your conduct may cause harm. Upon termination, your right to access the Services will cease and outstanding payment obligations remain due.
Governing Law
These Terms shall be governed by the laws of the State of Delaware, United States. Disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting a notice on our website, sending an email, or displaying a notice when you log in. Continued use constitutes acceptance.
